These Terms of Use ("Terms") govern your access to and use of the Ride of Passage App. By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
These Terms should be read together with our Privacy Policy.
1. About the App
Ride of Passage is a study and practice aid designed to help users prepare for the South African K53 learner's and driver's licence. The App provides educational content, quizzes, practice questions, road sign material and gamified learning features.
The App is a study tool only. It is not an official government product and is not affiliated with, endorsed by, or connected to any Driving Licence Testing Centre (DLTC), the Department of Transport, or any licensing authority.
2. Eligibility and accounts
- You must provide accurate registration information and keep it up to date.
- You are responsible for keeping your login details secure and for all activity on your account.
- If you are under 18, you confirm that a parent or legal guardian has consented to your use of the App and agrees to these Terms on your behalf.
- You may not share, sell or transfer your account to anyone else.
- Notify us immediately at hello@rideofpassage.co.za if you suspect unauthorised use of your account.
3. Purchases and access
- A once-off payment grants you full, permanent access to the App's paid content (all modules, questions, mock tests, flashcards and features), unless your account is suspended or terminated under these Terms.
- Access is granted for personal, non-commercial use only.
- We also offer a free tier with limited access, and a bulk/class option for driving schools and groups, as described in the App.
- Prices are shown in South African Rand (ZAR) and include VAT where applicable.
- We may change our prices from time to time. Price changes will not affect access you have already purchased.
4. Payments
- Payments are processed by our third-party payment provider, PayFast, a South African payment gateway. By purchasing, you agree to PayFast's terms.
- All payments are processed in South African Rand (ZAR) within South Africa. We do not accept or process cross-border payments.
- You authorise us (through PayFast) to charge the applicable fee for your chosen purchase.
- We are not responsible for failures, delays or errors caused by the payment provider, your bank, or your network.
5. Refunds and cancellations
- Once access has been purchased and granted to digital content, it is generally non-refundable, except where a refund is required by law.
- Your rights under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002 are not excluded by these Terms.
- If you believe you are entitled to a refund, contact us at hello@rideofpassage.co.za and we will assess your request.
6. Content disclaimer: accuracy and changes
This clause is important, so please read it carefully.
- The App's content is provided for general study and educational purposes only.
- Traffic laws, road signs, the K53 system, test requirements and official procedures can change. We make reasonable efforts to keep content current, but we do not guarantee that all content is accurate, complete, or up to date at all times.
- The App's content may become outdated between updates. The official K53 manuals, the National Road Traffic Act and its Regulations, and the rules applied at your testing centre always take precedence over anything in the App.
- You should always confirm current requirements with an accredited driving instructor, your local DLTC, or official government sources.
- We are not responsible for any decision, action, or outcome based on content in the App.
7. No guarantee of passing
- The App is a study aid. We do not guarantee that you will pass the learner's licence test, the driving test, or any assessment.
- Your results depend on many factors outside our control, including your own preparation, the examiner, the testing centre, and your performance on the day.
- Using the App does not entitle you to a licence and creates no expectation of a particular test result.
8. Gamification features (XP, streaks, badges)
- XP points, streaks, levels, badges and similar features exist purely to support and motivate your learning.
- They have no monetary value, cannot be exchanged for cash, and are not transferable.
- We may change, reset, or remove gamification features at any time without liability.
9. Acceptable use
You agree not to:
- Copy, reproduce, distribute, resell or publicly share the App's content
- Reverse engineer, scrape, or attempt to extract the App's content or code
- Use the App for any unlawful purpose
- Interfere with or disrupt the App, its servers, or its security
- Use automated tools to access the App without our permission
- Impersonate anyone or provide false registration information
We may suspend or terminate accounts that breach these Terms.
10. Intellectual property
- All content in the App, including text, lessons, questions, graphics, road sign illustrations, animations, the Ride of Passage name, logo, and design, is owned by or licensed to us and is protected by intellectual property laws.
- We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own study.
- You may not use our name, logo or branding without our written permission.
11. Third-party content and links
The App may reference or link to third-party content or services (for example, official traffic resources or payment providers). We are not responsible for the content, accuracy, or practices of third parties.
12. Availability and changes to the App
- We aim to keep the App available but do not guarantee uninterrupted, error-free access.
- The App may be unavailable during maintenance, updates, or for reasons beyond our control (such as network or load-shedding-related outages).
- We may add, change, or remove features, content, or modules at any time.
- We may update these Terms from time to time. Material changes will be notified in the App or by email, and continued use means you accept the updated Terms.
13. Limitation of liability
To the fullest extent permitted by law:
- The App is provided on an "as is" and "as available" basis.
- We are not liable for any indirect, incidental, or consequential loss, including loss arising from outdated content, reliance on the App, failed tests, or inability to access the App.
- Where we are found liable despite this clause, our total liability is limited to the amount you paid us for your access to the App.
- Nothing in these Terms excludes liability that cannot be excluded under South African law, including under the Consumer Protection Act.
14. Indemnity
You agree to indemnify us against any claims, losses, or costs arising from your misuse of the App or your breach of these Terms, to the extent permitted by law.
15. Suspension and termination
- You may stop using the App and request account deletion at any time.
- We may suspend or terminate your access if you breach these Terms, misuse the App, or where required by law.
- Termination does not automatically entitle you to a refund (see section 5).
16. Governing law and disputes
- These Terms are governed by the laws of the Republic of South Africa.
- You agree to first attempt to resolve any dispute with us directly by contacting hello@rideofpassage.co.za.
- The courts of South Africa have jurisdiction over any dispute, subject to your rights under the Consumer Protection Act.
17. General
- Severability: If any clause is found unenforceable, the rest of these Terms remain in force.
- No waiver: If we do not enforce a right, that is not a waiver of it.
- Entire agreement: These Terms and the Privacy Policy form the whole agreement between you and us regarding the App.
- Assignment: You may not transfer your rights under these Terms. We may transfer ours, for example if the business is sold.
